Pugtracker Posted October 13, 2023 Report Share Posted October 13, 2023 A fellow fulltimers tells me he has 60 days to come up with a brick and mortar address for his SOUTH Dakota bank or they will close his account. There were laws passed since 9/11 that set requirements for addresses with financial institutions las part of the Patriot Law package. The laws require a physical address for holding bank accounts and transferring money. If the bankers dig far enough into those laws, there is a provision for an alternate address arrangement with a second address of a permanent resident, near relative who will always know where you are. The problem is that many financial institution employees only see the main part of those rules and act, without any effort to dig into the fine print. Escapees RV Club has helped many of their members with that issue and most financial institutions they deal with rarely have that issue and they readily deal with the problem for their members when it does arise. If your friend is a member of Escapees, have him contact the business office for assistance. If not, he may need to get the help of an attorney. Steven L Posted October 15, 2023 Report Share Posted October 15, 2023 (edited) I'll be interested in hearing a more definitive answer from the O.P. as far as what their experiences are in successfully resolving this, as my wife and I were intending to establish residency and domicile in South Dakota sometime in the 1st quarter of 2024, and this is a concern for us. As well as the rather murky issues surounding voter registration in SOuth Dakota post S.B. 139. From what I've been able to glean online thusfar, there seem to remain questions about the level of strictness the South Dakota Secretary of State will intepret the wording of these new guidelines. Kirk W Posted October 15, 2023 Report Share Posted October 15, 2023 The problem is that all financial institutions now must deal with the federal regulations that have come out of the events of 9/11 and other terroristic activities that have since been prevented. If you read the linked regulation you will see that it doesn't require any specific type of address but it does require that the financial institution has sufficient proof of identity of the person or persons opening an account and a reasonably certain way to know where the owners are. The easiest way to do that is the requirement of a valid, physical, residential address that can be verified. There are other acceptable means but those require extra effort and rules by the financial institution and they may not be willing to make the extra effort. We just made SD our residency. I found out that with PMB on your license you cannot buy fire arms in SD! When we were residents of Fl and Tx through escapes this was not a problem. On banking we are with USAA so far no problem. We keep leaving Livingston TX as our mailing address. You register to vote when you get your driver's license. That law seems to not have votes to oust the full timers. Oh for registering your vehicles and RV you have to have your title in hand! That being said, I personally know of several individuals who still were able to purchase using their PMB address, by finding a smaller Mom & Pop retailer with a FFL who was willing to accomodate them. But if you go to any of the larger retailers such as Cabelas, Scheels, Sportsman's Warehouse, etc. then yes you will be denied as they are beginning to follow that law more strictly as of late. The voter registration issue ended up being something of a tempest in a teapot, as the newly enacted guidelines only require that you've resided a minimum of 30 days in state prior to application for registration. And they do not require those 30 days to be consecutive either. You fill out the same addivadit of application as before, only with the 30 day period detailed that you are swearing to under penalty of perjury, rather than 1 day as it was formerly. More than likely I'll be registering my vehicles online if I'm allowed to initially. Our 5th wheel was itself formerly regostered in South Dakota, so for us hopefully it will only entail a change of ownership on the title, which we have outright, free and clear. Yes mom and pop will make it a private sale. We were able to register to vote the day we got our license. Good discussion! UPDATE!!!! So update my friend who was going to get booted from a Wells Fargo bank is being allowed to stay. He provided a brick and mortar address of a relative and they will not close his account. He will now look for another bank so he does not have to impose on another person. NOT SURE if this is just SD BANKS but it is something to be aware of. It is not unique to SD as the issue is a federal law that applies to all financial institutions. That has been the case since the Patriot act was first passed.
